US and german Jurisprudence don't accept Trademark registration of TLDs. It's very good so for a free internet. (Only SLDs should respect Trademarks.)

You bring up a very interesting question:
Since in the past it was a very complicated matter to apply for a .TLD with ICANN, we do not know today how the courts will react if a private individual registers a trademark as a .TLD and the owner of the trademark complains about it.

I think it will be very exciting to watch this because so far there has never been such a case in court.
